The short answer

Unlike the RRSP, the TFSA has no $2,000 buffer. Every dollar over your contribution room is taxed at 1% per month for as long as it sits in the account. A $3,000 excess left for four months costs $120, plus a special return (Form RC243) due by June 30 of the following year.

How to do it

  1. Track your own room. CRA My Account shows your TFSA room, but the data lags — contributions made early in the year may not appear until financial institutions report them (often February). Keep your own running total: deposits minus withdrawals, against your lifetime limit.
  2. Withdraw the excess immediately. Don't wait for a CRA letter. The 1% tax is calculated on the highest excess in each month, so every month you wait adds another 1%.
  3. File Form RC243. If you had an excess at any point in the year, you must file the TFSA return and pay the tax by June 30 of the next year — even if you already withdrew the excess.
  4. Remember the withdrawal rule. Money you withdraw from a TFSA only restores contribution room on January 1 of the next year. Withdrawing $5,000 in November and recontributing $5,000 in December is an overcontribution.

Watch out

  • The classic trap: withdraw and recontribute in the same year. This is the #1 cause of accidental overcontributions among newcomers. Withdraw in December, recontribute in January.
  • Direct transfers don't count. Moving money straight from one TFSA to another (a direct transfer arranged by the institutions) is not a contribution. Doing it yourself as withdrawal + deposit is.
  • Deliberate overcontributions are punished harder. If the CRA decides you overcontributed on purpose to earn returns exceeding the 1% tax, a 100% "advantage tax" can apply to the income.
  • Non-residents get hit twice. Contributing while a non-resident can trigger two separate 1% monthly taxes. Newcomers who arrived mid-year should confirm their residency start date before contributing.

Frequently asked questions

The CRA hasn't notified me. Am I safe?

No. The CRA notifies on its own schedule, but the tax applies whether or not you got a letter, and you are still required to file the TFSA return.

Can the penalty be waived?

The CRA may waive it if you withdraw the excess (plus related income) promptly and can show it was a reasonable error. Write a clear explanation when you file — but don't count on it.

I have room again next year. Can I just leave the excess?

The excess will be absorbed when new annual room is added on January 1, and the monthly tax stops then. But you still owe the tax for every month the excess was in the account.
